관광산업 종사자의 산업재해 인정기준과 법적 쟁점 분석

This study reconstructs the criteria for recognizing industrial accidents within the tourism industry by categorizing major types of occupational injuries: emotional labor–related mental disorders, mobility- and seasonality-based injuries, overwork-related cerebrovascular and cardiovascular diseases, and physical injuries occurring during leisure- and experience-based tourism programs. Drawing on an extensive literature review, analysis of domestic and international cases, and sector-specific statistical data, the study identifies key risk factors and structural limitations of existing recognition standards. The results indicate that the tourism industry demonstrates structurally higher injury risks due to the combined effects of emotional labor, intensive face-to-face service work, mobility requirements, and seasonal employment patterns. The study further finds that current recognition standards insufficiently reflect industry-specific working conditions, particularly regarding mental disorders and overwork-related diseases. Accordingly, it proposes detailed recognition criteria for service-sector characteristics, sector-specific risk assessment indicators, separate standards for mobility and seasonal labor, and the introduction of a safety certification system for leisure-experience tourism programs. This research provides foundational insight for improving industrial accident recognition standards tailored to the tourism sector and supports future empirical and policy-oriented studies.
