다문화 사회의 통합 모델로서 헌법애국주의: 통합의 규범적 기준으로서 헌법과 탈민족주의적 관점의 재해석

Globalization and technological developments have intensified cross-border interactions, thereby accelerating the formation of multicultural societies. Germany, the largest country of immigration in Europe, has long relied on an ethnic conception of the nation as the basis for integration, demanding the unilateral adaptation of immigrants. This approach, however, reveals clear limitations in societies characterized by cultural and ethnic diversity. While North American liberal multiculturalism, grounded in the democratic principles of freedom and equality, has emerged as a modern model of integration, its full realization remains difficult within ethnically defined nation-states. To address these limitations, this study reinterprets constitutional patriotism, originally articulated from a post-nationalist perspective, in light of contemporary multicultural conditions and develops it into a model of integration applicable within the nation-state. Constitutional patriotism takes the universal values and democratic procedures embedded in the constitution as the normative basis of integration, enabling members of a multicultural society to cultivate solidarity and a sense of belonging through public deliberation and political participation. This approach mitigates cultural and identity losses resulting from both excessive pluralism and assimilation, and it offers a framework in which social diversity can coexist within the liberal-democratic constitutional order.
