한·미 법학전문대학원의 과학적 증거 교육과정 비교·분석 및 시사점

초록
본 연구는 한․미 양국 법학전문대학원의 과학 관련 교육과정을 4개 영역(과학적 방법론, 일반과학, 개별과학, AI 및 데이터사이언스)으로 분류하여 실증적으로 비교․분석하였다. 분석 결과, 미국 법학전문대학원은 실무 중심의 통계 교육, 타 전공과의 다학제적 세미나, 실습 위주의 전문 분야 교육 및 AI 리걸테크 커리큘럼이 활발히 운영되고 있었다. 반면 한국은 의료법 편중 현상이 심화되어 있고 기초 방법론 및 AI 관련 교육이 미비하며, 변호사 시험 준비에 치중된 교육 환경으로 인해 관련 과목이 폐강되는 등 구조적 한계를 보였다. 이러한 분석을 바탕으로 본 연구는 다음과 같은 정책적 시사점을 제시한다. 첫째, 학생들의 수강 부담을 완화하고 과학적 기초 소양을 함양할 수 있도록 과학 관련 과목에 대한 합격/불합격(Pass/Fail) 평가제를 도입해야 한다. 둘째, 타 학문과의 공동 강의를 통한실무 중심의 다학제간 교육 모델을 구축해야 한다. 셋째, 기술 가속화 시대에 부응하는미래 지향적 리걸테크 커리큘럼을 확충해야 한다. 본 연구는 양국의 규모 차이와 자료 접근성의 제한이라는 한계에도 불구하고, 현대 사법 시스템에서 법조인의 ‘과학적 소양’이 필수 역량임을 환기했다는 데 의의가 있다. 본 연구의 제언이 향후 법학전문대학원 설립 취지에 부합하는 전문 법조인을 양성하고, 사법 시스템 전반의 신뢰성을 제고하는 기초 자료로 활용되기를 기대한다.
Abstract
This study empirically analyzes forensic evidence curricula in South Korean and U.S. law schools across four domains: scientific methodology, general sciences, specialized fields, and AI/Data Science. The analysis reveals that U.S. law schools actively offer practice-oriented statistics, interdisciplinary seminars, and legal-tech curricula. In contrast, South Korean law schools exhibit a heavy concentration on medical law and face structural limitations where relevant courses are frequently canceled due to an educational environment focused on the Bar Exam. To address these issues, this study proposes introducing a Pass/Fail evaluation system to alleviate students' academic burden and establishing practice-oriented interdisciplinary models through joint lectures. Additionally, future-oriented legal-tech curricula must be expanded to prepare legal professionals for technological acceleration. Despite disparities in scale, this research emphasizes that ‘scientific literacy’ is an essential competency, providing foundational data to enhance the expertise and overall credibility of the judicial system.
