인공지능 기술 발전과 스포츠 시설 운영자의 안전배려의무에 관한 법적 연구

초록
스포츠의 저변확대로 스포츠가 대중의 여가 및 레저의 수단으로 활용되고 있다. 스포츠의 대중화는 골프장, 스키장 등과 같은 스포츠 시설에서 발생하는 안전사고의 증가의 원인으로 작용하고 있다. 골프장 인근에서는 골프장에서 날아온 골프공에 맞아 상해를 입는 사고가 발생하고, 스키장에서는 슬로프에서 앞서가던 스키 강사와 뒤따라오던 학생과 충돌하여 부상을 입는 사고가 발생했다. 이러한 사고는 스포츠 활동에 내재하고 있는 위험성뿐만 아니라 스포츠 활동에 필수적으로 수반되는 스포 츠 시설의 특수한 위험성을 보여주는 사례이다. 스포츠 시설과 관련된 사고는 단순히 이용자의 과실로 치부할 것이 아니라, 시설의 구조, 관리 및 운영 전반에 걸친 안전관 리 시스템의 문제로 바라보아야 한다. 일반적으로 스포츠 사고, 특히 스포츠 시설 운영장의 사고는 사고가 발생한 후 운영장의 안전배려의무를 중심으로 논의되어 왔다. 사고 발생 이후 위험성의 예견가능성과 회피 가능성을 중심으로 운영자의 주의의무 위반 여부에 따라 민사책임이 나 형사책임을 인정하였다. 그러나 인공지능 기술의 발전으로 위험을 사전에 예방할 수 있는 기술적 조치가 가능하게 되었고, 이는 운영자의 안전배려의무를 판단함에 있어 새로운 기준으로 역할 할 수 있게 되었다. 특히 2021년에 제정된 ｢중대재해처벌법｣은 스포츠 시설 운영자가 기존의 스포츠 시설에서 기울이던 안전배려의무를 넘어서서 동 법에서 정하고 있는 일정한 요건에 해당되면 중한 형사 책임을 지게하고 있어 스포츠 시설 운영자들은 인공지능 기술 전면 도입에 대해 상당히 심각하게 고려하고 있고 재정난을 겪고 있는 국공립 스포츠 시설 등에는 사전예방 위험 구축체계 마련을 위해 국가적 지원이 절실히 필요한 실정이다. 골프공의 비거리와 낙하지점을 예측하는 인공지능 기술, 스키장의 이용자 속도⋅ 동선을 분석하여 충돌 위험을 사전에 경고하는 인공지능 시스템은 과거에는 불가능 했던 수준의 위험 예견을 가능하게 한다. 이러한 기술이 도입될 경우, 스포츠 시설 운영자는 단순히 사고 발생 이후의 대응에 그치지 않고, 사고 발생 가능성을 사전에 인식하고 이를 예방할 수 있게 되어 ｢중대재해처벌법｣상 중대시민재해 책임을 보다 합리적으로 준수할 수 있을 것이다. 본 연구는 스포츠 시설 운영자의 안전배려의무를 기존 책임을 살펴보고 ｢중대재해 처벌법｣으로 스포츠 시설 운영자의 책임이 어떻게 변화되었는지 살펴본 뒤 인공지능 기술 도입 시 어떠한 법적 변화가 올 수 있는지를 예상하여 스포츠 시설에서의 인공지능 기술 활성화를 가져오고자 한다.
Abstract
The growing popularity of sports has led to their use as a means of leisure and recreation for the public. This popularization of sports has led to an increase in safety accidents occurring at sports facilities such as golf courses and ski resorts. Near golf courses, injuries have occurred due to golf balls flying from the course, while at ski resorts, injuries have occurred due to collisions between ski instructors and students following behind on the slopes. These accidents highlight not only the inherent risks of sports activities but also the unique risks inherent in sports facilities. Accidents related to sports facilities should not be simply attributed to user negligence, but should instead be viewed as a problem within the overall safety management system encompassing the facility’s structure, management, and operation. Sports accidents, particularly those at sports facilities, have typically been discussed with a focus on the operator’s duty of care after the accident. Civil or criminal liability has been recognized based on whether the operator breached their duty of care, focusing on the foreseeability and culpability of the risk. However, advances in artificial intelligence have made it possible to implement technological measures to prevent risks in advance, which can serve as a new standard for assessing the operator’s duty of care. In particular, the ｢Serious Disaster Punishment Act｣ enacted in 2021 goes beyond the safety considerations that sports facility operators had in existing sports facilities and requires them to unconditionally take responsibility for the consequences if certain requirements stipulated in the Act are met. Therefore, sports facility operators are seriously considering the full introduction of artificial intelligence technology, and national and public sports facilities that are experiencing financial difficulties are in dire need of national support to establish a preemptive risk prevention system. AI technologies that predict the distance and landing point of a golf ball, and AI systems that analyze the speed and movement of skiers to warn of collisions in advance, enable a level of risk prediction previously impossible. The introduction of these technologies will allow sports facility operators to go beyond simply responding to accidents after they occur, enabling them to proactively recognize and prevent potential accidents. This will allow them to more effectively comply with the Serious Disaster Punishment Act’s responsibilities for serious civil disasters. This study examines the existing safety considerations of sports facility operators and how the Serious Disaster Punishment Act has changed their responsibilities. It then anticipates potential legal changes resulting from the introduction of AI technology, aiming to foster the adoption of AI in sports facilities.
