본 연구는 외국인 부동산 매수에 대한 주요 국가들의 제도적 대응 방식을 정책수단 이론의 관점에서 비교･분석하고, 이를 통해 한국의 외국인 부동산 거래 관리 정책에 대한 시사점을 도출하는 것을 목적으로 한다. 최근 한국에서는 외국인 부동산 거래 과정에서 자금 출처 불투명, 편법 증여, 무자격 임대업 등 위법･편법 사례가 반복적으로 적발되며 관리･감독 강화의 필요성이 제기되고 있다. 그러나 기존 논의는 단속이나 규제 강도에 초점을 두는 경향이 강해, 국가별 정책수단 선택을 체계적으로 비교한 연구는 제한적이었다. 이에 본 연구는 정책수단 이론을 분석 틀로 적용하여 외국인 부동산 매수 정책을 직접 규제형, 과세형, 관리･감독형의 세 가지 유형으로 구분하고, 주요 국가 사례를 비교 분석하였다. 분석 결과, 각 국가는 주택시장 구조와 정책 목표에 따라 상이한 정책수단 조합을 선택하고 있는 것으로 나타났다. 이러한 비교 결과를 토대로 본 연구는 외국인 부동산 취득을 원칙적으로 허용해 온 한국의 제도적 특성을 고려할 때, 전면적 규제나 일률적 과세보다는 관리･감독 수단의 정교화를 중심으로 한 정책 접근이 보다 현실적인 방향일 수 있음을 제시한다.
Abstract
This study comparatively analyzes policy responses to foreign property purchases across selected countries through the lens of policy instrument theory and derives institutional implications for Korea. While concerns over foreign property transactions in Korea—such as opaque capital flows and unauthorized rental activities—have intensified, existing discussions have largely focused on enforcement or regulatory stringency, with limited cross-national comparison of policy instrument choices. Applying policy instrument theory, this study identifies three policy types: direct regulation, taxation-based control, and management and supervision. The analysis shows that countries adopt different combinations of these instruments depending on housing market conditions, economic openness, and policy objectives. The findings suggest that, given Korea’s long-standing openness to foreign property ownership, refining management and supervision mechanisms may represent a more institutionally consistent approach than comprehensive prohibitions or uniform taxation. By typologizing international policy responses from a policy instrument perspective, this study contributes to comparative research on foreign property governance and offers a framework for future policy design in Korea.
