Structural Shifts in AI Criminal Liability and Standardization of Criminal Justice Procedures: Focusing on Evidence Collection and Public Prosecution of AI Negligence

본 연구는 대법원 판례가 확립한 과실범 법리(주의의무 위반)를 바탕으로, 인공지능(AI) 활용사건에서 발생하는 과실 입증의 실무적 난제를 분석하고 이에 부합하는 수사 및 증거수집 절차의표준화 방안을 제안하고자 한다. 특히 기존 판례가 전제하는 '인간의 단독 주의의무' 모델이 AI의복잡한 의사결정 구조에서 노출하는 한계를 식별하고, 이를 극복하기 위한 국내 학술 담론의 변화양상을 텍스트마이닝과 랜덤포레스트 기법으로 분석하여 규범적·실무적 대안을 도출하였다. 분석결과, 형사책임 논의는 초기 개인(2022)과 조직(2023)의 이분법적 대립을 거쳐, 2025년에는개인의 판단 역량과 조직의 운영 설계가 결합된 ‘다층적 협력 구조’로 수렴함을 확인하였다. 특히 이과정에서 기술은 독립된 책임 주체가 아닌, 행위와 운영이 전개되는 ‘작동 환경’으로 기능한다는 점이데이터로 입증되었다. 이는 AI 형사사건의 초점이 결과에 대한 단순 귀속이 아닌, 판단·검토·운영으로이어지는 ‘연속적 의사결정 경로’를 추적하여 주의의무 위반을 검증하는 과정으로 전환되어야 함을시사한다. 이에 본 연구는 공판 단계에서 모호한 AI 과실의 예견가능성과 회피가능성을 명확히 입증할객관적 증거 확보 방안으로, ‘판단 경로 기록’의 조서 및 수사 서식화와 조직의 ‘운영 연속성 기록’ 보존의무화를 포함한 형사사법절차 표준화 모델을 제시하였다.
Abstract
This study focuses on the challenges in both investigation and trial practices where the attribution of criminal responsibility and the proof of negligence become ambiguous due to the intervention of Artificial Intelligence (AI). The purpose is to empirically identify shifts in the structure of responsibility attribution and propose standardized procedures for evidence collection and criminal justice aligned with these changes. To this end, the study analyzed domestic academic discourse from 2022 to 2025 using text mining and Random Forest classification techniques. The analysis revealed that the discourse on responsibility, initially dichotomized into individual (2022) and organizational (2023) focus, converged into a ‘multi-layered responsibility structure’ in 2025, balancing individual judgment competence with organizational operational design. Furthermore, technology was identified as an ‘operational environment’ rather than an independent subject of responsibility.
