헌법상 국가책무의 제도화와 민주시민교육: 평화통일 민주시민교육법의 입법구성을 중심으로
The Institutionalization of Constitutional Duties and Democratic Citizenship Education: A Study on the Legislative Framework of a Peaceful Unification Civic Education Act

본 연구는 「대한민국 헌법」 제4조가 명시한 평화통일 과제를 전제로, 평화통일 민주시민교육을 정책사업이 아니라 헌법형성적 입법의 대상으로 파악하고, (가칭) 「평화통일 민주시민교육법」의 입법구조를 제시・검토한다. 현행 「통일교육지원법」은 통일부 기본계획을 매개로 하는 행정조정형 법률로서, 특히 제8조 제2항이 통일부장관의 ‘요청’이 있는 경우에만 교육과정 반영 의무가 발생하는 조건부 구조를 취한다. 이러한 설계는 학교교육과정의 상시적 내재화, 평가체계 및 교원 전문성 연계, 재정의 안정화와 같은 교육법제의 핵심 구성요소를 구조적으로 담보하기 어렵게 하며, 결과적으로 통일교육을 정책 우선순위와 집행 재량에 종속될 위험에 노출시킨다. 이에 본 연구는 「헌법」 제4조・제31조・제37조 제2항・제7조 제1항・제92조의 체계에 기초하여, 중앙의 기준설정과 분권적 집행을 결합하는 거버넌스(독립위원회), 교육자치/일반자치 이원 집행, 교육대상별 차등의무 설계, 재정의 법률화 및 의회통제, 통일헌법 단계 연계를 포함하는 통합적 입법모델을 제안한다. 이는 평화통일 민주시민교육을 ‘정당화’에서 ‘제도 설계’로 전환함으로써, 헌법상 국가책무의 지속가능한 법제화를 도모한다.
Abstract
This study proceeds from the constitutional premise that Article 4 of the Constitution of the Republic of Korea imposes upon the State a duty to pursue peaceful unification. Rather than treating peace-unification democratic civic education as a contingent policy initiative, this article conceptualizes it as an object of constitution-shaping (Gestaltende) legislation and proposes an institutional design for a hypothetical Peace Unification Democratic Civic Education Act. The central argument is that the existing statutory framework fails to ensure the continuous and binding internalization of such education within the ordinary legal order. The current Act on Support for Unification Education operates primarily through an administrative coordination model centered on the Ministry of Unification’s basic plans. In particular, Article 8(2) establishes a conditional duty structure under which curricular reflection occurs only upon the Minister’s “request.” Although this mechanism facilitates inter-ministerial coordination, it does not structurally guarantee the sustained incorporation of unification-related civic education into the national curriculum. Nor does it sufficiently secure its integration with assessment systems, teacher professional development, or stable fiscal foundations. Consequently, unification education remains vulnerable to shifting policy priorities and administrative discretion, undermining its character as a constitutionally grounded and enduring state responsibility. To overcome these structural limitations, this study develops a legislative model grounded in Articles 4, 31, 37(2), 7(1), and 92 of the Constitution. First, it proposes a governance structure that combines central constitutional standard-setting with decentralized implementation, including the establishment of an independent coordinating body responsible for articulating long-term normative guidelines while respecting educational autonomy. Second, it designs a dual implementation framework reflecting the constitutional distinction between educational autonomy and general local autonomy, thereby ensuring coherent operation across school-based and lifelong education sectors. Third, it differentiates the scope and intensity of educational duties according to the constitutional status of addressees—students in compulsory education, public officials and teachers as constitutional functionaries, and adult citizens as rights-holders—thus aligning legislative design with proportionality requirements. Fourth, it emphasizes the legalization of fiscal foundations and parliamentary oversight to secure sustainability beyond discretionary annual budgeting. Finally, it situates peace-unification civic education within a broader constitutional trajectory by linking it to a potential future unification-constitution phase as an institutional foundation for democratic continuity. By shifting the focus from normative justification to institutional design, this study advances a concrete legislative model for embedding a constitutional state duty within Korea’s educational and governance structure in a sustainable and structurally coherent manner.
